Threat to Cause Physical Injury ARS 13-1202 (Phoenix) - Dismissed  Day of Trial
This case angered me more than most. My client was just released from custody on Aggravated Assault Dangerous charges. The City of Phoenix decided to pick up misdemeanor charges out of the same police report as Aggravated Assault. To make things worse, the City of Phoenix treated the threat like it was the worst crime ever committed. The alleged threat was all made over text messages to my client's wife. The name of the individual allegedly threatened was never texted. To even have a chance to prove the case would require my client's wife to testify at trial. She did not appear. The alleged victim was present. Case dismissed in full.
