Implied Consent (MVD/ADOT - Scottsdale) 1 Year Suspension Vacated

Client was arrested for DUI in Scottsdale. She refused to give a sample of her blood during the investigation and Scottsdale Police suspended her license for 1 year pursuant to Implied Consent. Everything was on video. My client did refuse to give her blood. However, in watching the video, it was quickly learned the Scottsdale Police read her the wrong form. She was not properly advised of her blood rights. I pressed the officer on this issue during our interview. I scared him. The Scottsdale officer did not appear for our implied consent hearing at MVD/ADOT and the one year suspension was voided.
