DUI .091 (Scottsdale) - Reduced to Reckless Driving

My client was in town working. He was the designated driver, but had a few. Being lost in Scottsdale he made a left hand turn on a red arrow. A Scottsdale Police Officer was stopped right next to him. My client was pulled over and run through the DUI investigation while his passenger was throwing up in the parking garage. The officer insisted my client smoked marijuana. He did not.
Scottsdale typically does a breath and blood test. However, this officer knew my client was close to the legal limit. For that reason he only did a blood test (because it typically comes back higher than breath). The results were a .091BAC. I had the blood tested at my lab and the result was a .084BAC. After 4 months of negotiation (and having another case reduced to reckless driving the dat prior to trial) I convinced the prosecutor to offer a reckless driving. My client accepted!
This plea saved my client $1000, a license suspension, and he no longer has to install the interlock in his vehicle.
