Drug DUI with Accident (Phoenix) -Dismissed -
This was an underage DUI alcohol and drugs in Phoenix. My client was involved in a single vehicle accident. his car rolled. The passenger blamed my client. My client was seriously injured and rushed to the hospital. The cops said the could smell a strong odor of alcohol on my client, bu he was only a .03 (odd). The Phoenix police obtained a sample of his blood without a warrant based on the hospital blood draw exception and what they claim was probable cause because of an accident and the odor of alcohol. My client's blood returned with a massive amount of drugs in it. I filed a motion to dismiss after our investigation found flaws in the Phoenix investigation. The case was dismissed in full and my client's record is clean!
