Driving on a Suspended License (Phoenix) - full acquittal at trial - 11/3/2016 at trial
  • We went to trial in Phoenix Municipal Court on a driving on suspended license charge. During trial the cop testified that my client was driving. However, he never saw her in the car. This created a Corpus issue. Corpus is a legal term of art. Basically, the State cannot convict with a confession alone. There must be independent proof of a crime.
  • Here, there was no proof of a crime. The state did not bother to call a witness to put my client behind the wheel. We won! Sometimes it is worth fighting a case.
Driving in Suspended is a class 1 misdemeanor. You could be fined up to $2500 plus surcharge, 6 months in jail and 3 years of probation. If you have been charged with Driving on suspended license in Phoenix call me. 480-729-1682. The initial consultation is always free!
