Can I be charged with a DUI in Phoenix with a blood alcohol content less than the legal limit?

As you know, Arizona is a no-tolerance state for driving under the influence (DUI). You can actually be arrested with a blood-alcohol content (BAC) less than the legal limit of 0.08. If the government can prove that your Blood Alcohol Concentration was a .08% or more within two hours of driving the prosecution will add another charge. Right now the City of Phoenix is prosecuting a .078 BAC. My client has never been in trouble. His blood is below the legal limit, the prosecution does not care.
