Misdemeanor Assault

If you have been charged with misdemeanor assault charges the consequences can be life-altering. The charges can range from a class 1 misdemeanor to a class 3 depending on the circumstances of the alleged assault.
  • Class 1 Misdemeanor – This is the most serious of misdemeanor charges in that you have intentionally caused physical injury to another person. If proven that you actually caused physical harm the result can be 6 months in jail.
     
  • Class 2 Misdemeanor – A class 2 misdemeanor charge can be the result of intentionally placing someone in imminent physical injury. This charge doesn’t require that you actually touched someone however, you have put someone in fear of serious injury. The result can be up to 4 months in jail, probation, anger management classes, community service and monetary fines.
     
  • Class 3 Misdemeanor – If you knowingly touched another person with intent to cause physical injury, insult or provoke them, you may be facing a class 3 misdemeanor. The charges can result in a fine and up to 30 days in jail. In addition, you may face probation, community service, and classes.

Aggravated Assault                   

Aggravated assault can be the result of several different circumstances such as causing serious physical injury to another person, committing injury to someone while using a deadly weapon or physically restraining someone.

A class 3 felony, the penalties for aggravated assault can range from 5-15 years in prison for your first offense to 10-20 years for a second conviction and 15-25 years for a third conviction.
