Assault Domestic Violence (Phoenix) - Dismissed at trial

Sometimes we want to refuse diversion and set a Domestic Violence Assault case to trial. In this case my client was accused of of punching his father at a bus stop. A witness called 911 to report the crime. We investigated the case for two months and we set this case to trial and refused any plea offer. During our investigation it was learned the father is now living on an Indian reservation. The importance of this information is that the City of Phoenix cannot serve a subpoeana on the Reservations. On the day of trial the alleged Domestic Violence victim did not appear. The alleged witness did not appear. The City of Phoenix was not prepared for trial and my client's case was dismissed.
