Yet another Domestic Violence Assault case dismissed in the City of Phoenix. My client was accused of beating up his roommate. Roommate called police around 11:30pm to report the incident just occurred. Problem was the alleged victim said they were eating dinner and watching football when this all occurred. Well, not many people eat at 11pm and there is no football on at that time either. At trial on the assault the State admitted they were not prepared and the case was dismissed.
