Assault, Criminal Damage, Disorderly Conduct - Domestic Violence (Phoenix) - Dismissed at trial- 5/4/2017

Sometimes we want to refuse diversion and set a Domestic Violence  case to trial. In this case my client was accused of attacking his girlfriend (assault), Criminal Damage and Disorderly Conduct.  On the day of trial the alleged Domestic Violence victim appeared in court as did another witness. With some fine lawyering I was able to convince the State their case was weak. Instead of trying the case against me, they simply dismissed the charges. This case was interesting. The victim called the police, but she told them she was not willing to prosecute. Typically, this does not matter, particularly when the victim still shows up in court. However, sometimes it pays to have a lawyer who knows what to do in these situations. My client walked out of court a free man.
