ARS 28-672 Causing Death by Moving Violation (Phoenix) - Not Guilty at Trial
Back to all DUI & Criminal Defense Case Results
My client worked as a cement truck driver. He was dropping a load and making a left when a drunk driver with a BAC over a .30 slammed into him. She passed away at the scene. Despite the fact she was heavily intoxicated and had open beer cans in the car, the police charged my client with a crime. He lost his job and career because of the charge. Then, I was brought on the case. An expert was immediately hired. Despite the State having three experts testifying to the contrary, we were able to prove the decedent pulled out of her lane turn lane and slammed right into the cement truck. She never saw it because she was too drunk to react.
The worst thing about this case was the fact there were two eye witnesses. The City of Phoenix does not care about justice. They did not try to find the eye witnesses. They did not bring them to trial. The City of Phoenix completely ignored the fact both eye witnesses saw the decedent turn into a left hand turn lane, immediately change her mind, pull out of the lane and slam into the cement truck.
