My client was charge with his second DUI in 7 years. A Second Time Extreme DUI is the consequence of new DUI charge within 84 months of date of 1st DUI conviction. A result of driving under the influence with a BAC (Blood alcohol content) above .15 however, less than .20, and extreme DUI carries a mandatory 120 days in jail.

Extreme DUI Penalties in Arizona

  • Minimum Jail - 30 days jail

In some but not all circumstances you may be able to serve out your sentence at home. While on Home Detention you would be required to wear a GPS monitor and have a machine installed in your house that will require you to submit to 3 random alcohol tests per day. Since this was a county case the Judges in Maricopa County are prohibited from handing down sentences for home detention so jail time was inevitable.

Sentance reduction

I was able to get the charges against my client reduced to a regular DUI and their jail sentence was lowered to 90 days. My client served every day in jail however, he was able to get work release for 6 days a week and 2 hours per day.
