Can I be charged with a DUI in Phoenix with a blood alcohol content less than the legal limit?

As you know, Arizona is a no-tolerance state for driving under the influence (DUI). You can actually be arrested with a blood-alcohol content (BAC) less than the legal limit of 0.08. If the government can prove that your Blood Alcohol Concentration was a .08% or more within two hours of driving the prosecution will add another charge. Right now the City of Phoenix is prosecuting a .078 BAC. My client has never been in trouble. His blood is below the legal limit, the prosecution does not care. The prosecution is not making an offer and trying to prosecute my client to the fullest extent of the law. I am here to protect him, and you, from over zealous prosecutors.

1st time misdemeanor driving under the influence penalties for being "impaired to the slightest degree" are listed below. After reviewing them I’m sure you would have to agree that it would be far easier and safer to take a taxi or ask a friend to be the designated driver.
